Terms & Agreements

  1. WARRANTIES- All statements accompanying entries in the sales catalog are representations made by consignors and are for general information only. Missouri Horse Auction Sales Inc. at Mountain Grove assumes no responsibility for the accuracy of any such statements. Additional information will be provided from the auction platform immediately before sale of each animal and will take precedence over any written material. Buyers, therefore, should pay strict attention to all announcements by the auctioneers and sales personnel, but should personally assure themselves in such fashion as they may choose as to the various characteristics of any and all animals they purchase.
  2. CHALLENGES- If any animal purchased does not meet the representation made at the time of sale, any and all questions must be raised immediately and reported to the sales managers. Missouri Horse Auction Sales Inc. assumes no responsibility or liability in such matters.
  3. BIDS- The official Auctioneer shall be the judge of any dispute regarding bids and shall follow rules of practice established in the profession. The highest bidder will be the buyer, and if a dispute arises between two or more bidders, the horse in dispute shall immediately be put up again for advance bids. If there be no advance, the horse shall go to the person from whom the auctioneer recognized the last bid. The sales management or Auctioneer is authorized to decline any bid by intoxicated or disorderly parties, or by those who defaulted on former purchases, or by anyone who, in their judgement, is not a reliable or responsible party. Those parties may also be asked to leave the sale ground.
  4. PAYMENT- All payments must be paid in full to the sales office the same date of the sale. Acceptable forms of payments are cash, check with proper forms of identification, or credit card (3.5% convenience fee).
  5. OWNERSHIP- All animals are the property of the sellers until the fall of the auction gavel, at which time they become the property of the buyer. At no time does Missouri Horse Auction Sales Inc assume any liability for, or custody of said animal. 
  6. CARE- Buyers must make arrangements for care of stock until it can be transported.
  7. TRANSPORTATION- Transportation arrangements are the responsibility of the Buyer and must be removed from the premises by the next day at noon, unless prior arrangements have been made with the sale company.
  8. LIABILITY- Spectators, buyers, sellers are aware of the danger presented by numerous large animals in the sale ring and on the grounds, and are at their own peril in conducting themselves. Missouri Horse Auction Sales Inc. accepts or claims NO responsibility for any injuries or accidents occuring.
  9. ALL SALES ARE FINAL.

 

INTERNET BIDDERS PLEASE READ!

ALL BUYERS MUST BE 18 YEARS OF AGE. BY REGISTERING AND BIDDING YOU ACKNOWLEDGE THAT YOU ARE 18 YEARS OF AGE AND AGREE TO THE TERMS, CONDITIONS AND DISCLAIMERS LISTED WITHIN.

  1. ONLINE BUYER REGISTRATION must be complete prior to bidding via the bidders registration online. Missouri Horse Auction Sales Inc. reserves the right to accept or decline bidders registrations for any reason they see fit. 

  2. BIDDER VERIFICATION will be made by a $500 credit card hold to activate and verify that the bidder is a real person and to prevent fraudulent activity. This also ensures that all bidders are bidding with intent to purchase and to uphold the integrity of the sale. This is not a charge, but a preauthorization or "pending transaction". When the auction you are registered for is complete and the auction settlement is finalized, the pre-authorization will be released if you are not a high bidder of any lot in the auction. If a winning bidder fails to complete payment within 48 hours of the end of the auction, Missouri Horse Auctions has permission to charge your card for the full amount of final bid. PLEASE BID RESPONSIBILY! THIS AGREEMENT IS A LEGAL BINDING CONTRACT.


BY PLACING A BID you are acknowledging that you are entering a legally binding contract to purchase the horse in which the ending bid was made of the auction. Once a bid is placed, you CANNOT WITHDRAW OR CANCEL YOUR BID. Any attempts to do so OR FAILURE TO PAY FOR A WINNING AUCTION WOULD BE CONSIDERED IN DEFAULT AND COULD RESULT IN LEGAL RAMIFICATIONS TO SETTLE THE ACCOUNT. Please only bid on the animals that you intend to complete the purchase on. Any horse that is a result of an unpaid auction can be resold by the seller by any means that they decide without any notice to the default buyer.
