ALL BUYERS MUST BE 18 YEARS OF AGE. BY REGISTERING AND BIDDING YOU ACKNOWLEDGE THAT YOU ARE 18 YEARS OF AGE AND AGREE TO THE TERMS, CONDITIONS AND DISCLAIMERS LISTED WITHIN.
ONLINE BUYER REGISTRATION must be complete prior to bidding via the bidders registration online. Missouri Horse Auction Sales Inc. reserves the right to accept or decline bidders registrations for any reason they see fit.
BIDDER VERIFICATION will be made by a $500 credit card hold to activate and verify that the bidder is a real person and to prevent fraudulent activity. This also ensures that all bidders are bidding with intent to purchase and to uphold the integrity of the sale. This is not a charge, but a preauthorization or "pending transaction". When the auction you are registered for is complete and the auction settlement is finalized, the pre-authorization will be released if you are not a high bidder of any lot in the auction. If a winning bidder fails to complete payment within 48 hours of the end of the auction, Missouri Horse Auctions has permission to charge your card for the full amount of final bid. PLEASE BID RESPONSIBILY! THIS AGREEMENT IS A LEGAL BINDING CONTRACT.
BY PLACING A BID you are acknowledging that you are entering a legally binding contract to purchase the horse in which the ending bid was made of the auction. Once a bid is placed, you CANNOT WITHDRAW OR CANCEL YOUR BID. Any attempts to do so OR FAILURE TO PAY FOR A WINNING AUCTION WOULD BE CONSIDERED IN DEFAULT AND COULD RESULT IN LEGAL RAMIFICATIONS TO SETTLE THE ACCOUNT. Please only bid on the animals that you intend to complete the purchase on. Any horse that is a result of an unpaid auction can be resold by the seller by any means that they decide without any notice to the default buyer.
HOW TO BID, BIDDER DISPUTES, EQUIPMENT/SOFTWARE/PROGRAM ERRORS. During an active auction, bidders can place their bids with two bidding options: 1. Enter each bid as the highest bid increases, engaging in a competitive bidding atmosphere. 2. Enter maximum bid in which the auction platform will automatically enter the lowest bid amount possible until you are outbid. Max bids are secret to each bidders account and are never shared to the public! All auctions have scheduled ending times with each lot ending with a two minute soft close. Example: Lot 1 has a scheduled ending time of 6:00 PM. At 5:59 PM Lot 1 receives a new high bid. The ending time for Lot 1 will be extended two minutes making the new ending time of 6:01 PM unless another bid is placed. This two minute extension will occur until the lot no longer receives a bid past the two minute extension. This allows for all bidding parties to make a confident and final bid without being outbid at the last second. Missouri Horse Auction Sale Inc. bidding platform is lightning fast and at real-time speed. Please ensure that as a bidder, adequate and good internet connection is available so no bids are missed due to poor connection. Missouri Horse Auction Sales Inc. shall be the judge of any dispute regarding bids between two or more bidders shall an issue arise. This decision shall stand absolute and be final. If in the event that equipment, software, or program fails, the auction will pause until the problem is resolved in which the auction shall resume. Any auctions coming to a close prior to equipment failure will be considered sold and the sale will follow all terms, conditions, and disclaimers listed within.
WARRANTIES. All statements accompanying auction listings in the online sales catalog are representations made by the seller. Missouri Horse Auction Sales Inc. assumes no responsibility for the accuracy of any such statements. Buyers should pay strict attention to all information given to personally assure themselves in such fashion as they may choose as to the various characteristics of any and all animals they purchase. Buyers are encouraged to INSPECT/TEST RIDE HORSE PRIOR TO BIDDING OR PURCHASING. Veterinary examinations of bidders choice are welcome AT THE BUYERS EXPENSE PRIOR TO CLOSING OF A SALE. It is the responsibility of the bidder to complete satisfactory BUYERS DUE DILIGENCE. No warranties are given by Missouri Horse Auction Sales Inc. to the soundness, health, condition, fitness, level of training of any horse that is listed in the sales. No pre-purchase exams will be acknowledged or accepted AFTER the completion of a sale. ALL HORSES OFFERED ARE SOLD “AS IS” AND WITH ALL DEFECTS.
CHALLENGES. Sellers agree to give all information about the horse they are auctioning in full truth. If any animal purchased does not meet the representation made at the time of sale, any and all questions must be raised immediately and reported to the sale managers. MISSOURI HORSE AUCTION SALES INC. ASSUMES NO RESPONSIBILITY OR LIABILITY IN SUCH MATTERS. MISSOURI HORSE AUCTION SALES INC. REPRESENTS THE COMMISSION COMPANY THAT BRINGS THE BUYERS AND SELLERS TOGETHER. ALL GUARANTEES ARE BETWEEN THE BUYER AND SELLER.

TERMS OF SALE are cash and payment in full made to the sale office of Missouri Horse Auction Sales Inc. within 48 hours of the end of the auction. Accepted forms of payments are listed below:

Buyers will be contacted by a Missouri Horse Auction Sales Inc. representative within minutes of a sale ending to initiate payment. Payments must be made directly to Missouri Horse Auction Sales Inc., no exceptions. Once payment has been completed, Missouri Horse Auction Sales Inc. will notify the seller of the completion of sale. It is then the responsibility between the buyer and seller to complete the necessary transportation arrangements. Missouri Horse Auction Sales Inc. can assist in finding transportation companies, but will not complete the arrangements. That is solely the buyer's responsibility. ANY DEFAULTED PAYMENT FOR A HORSE IS SUBJECT TO THE CREDIT CARD ON FILE BEING CHARGED FOR THE AMOUNT OF ANY AUCTION WON! Please only bid with full intent and ability to pay for the horse you purchase.
ALL PAYMENTS FOR HORSES MUST CLEAR AND BE COMPLETE BEFORE LEAVING THE SELLERS LOCATION. NO HORSE SHALL EXCHANGE POSSESSION FROM THE SELLER TO THE BUYER/BUYERS REPRESENTED TRANSPORTATION UNTIL PAYMENT IS VERIFIED THROUGH MISSOURI HORSE AUCTION SALES INC.
REGISTRATION CERTIFICATES– All required paperwork, registration papers, signed transfers, breeders certificates, registration applications, etc. must be mailed to Missouri Horse Auction Sales Inc. PRIOR to the auction end date and time. If not, Missouri Horse Auction Sales Inc. will settle with the seller ONLY after the necessary paperwork is forwarded to the sales office or ONLY after the buyer has approved such paperwork in writing. Any further provisions of papers should be between buyers and sellers. At the end of an auction, all acquired paperwork for a horse will be mailed to the buyer ONLY AFTER PAYMENT IS MADE AND CLEARED IN FULL.
OWNERSHIP TRANSFER AND RISKS. Ownership transfers immediately to the buyer upon the final winning bid. Upon the transfer of ownership, risks include, but are not limited to, illness, injury or death of horse. The new owner (buyer) assumes all financial responsibility for the care and maintenance of the horse. Any damages or losses caused by the horse additionally are the responsibility of the owner upon ownership transfer. Buyer agrees to hold harmless Missouri Horse Auction Sales Inc. of any damages made by the horse.
TRANSPORTATION. It is the responsibility for the bidder to have transportation arrangements made within ONE WEEK (seven days) of the ending date of the sale. Any horse that does not have transport arranged within one week is subject to boarding fees set by the seller that will be paid directly to the seller.
LIABILITY– Missouri Horse Auction Sales Inc. is an independent contractor that brings buyers and sellers together via an online timed consignment Auction. These online sales allow for the public to view online videos, pictures of an animal connecting buyers and sellers with the intent of completing a sale of a specific horse. No animals are owned by Missouri Horse Auction Sales Inc. therefore, no liability can be placed on Missouri Horse Auction Sales Inc., including but not limited to loss, damage, injury, death, or illness of any horse, person or property before, during, or following a sale.
CHOICE LAW– THE LAW OF THE STATE OF MISSOURI SHALL GOVERN THE INTERPRETATION OF THESE TERMS, CONDITIONS, AND DISCLAIMERS IF ANY DISPUTE OR ISSUES ARISE THAT RELATE TO THE SALE OF ANY AUCTION SET BY MISSOURI HORSE AUCTION SALES INC. THE USERS, BIDDERS, BUYERS, SELLERS, AGREE TO THE COURT OF CHRISTIAN COUNTY, MISSOURI TO RESOLVE ANY DISPUTES OR MATTERS IN WHICH THE TERMS OF THIS AGREEMENT MUST BE ENFORCED. ALL USERS OF MISSOURI HORSE AUCTION SALES INC. FORFEIT THE RIGHT TO CHOOSE JURISDICTION OR VENUE IF ANY ACTION ARISES DUE TO BREACH OF TERMS, CONDITIONS, AND DISCLAIMERS.
SELLER AGREEMENT, TERMS AND CONDITIONS
Sellers will be paid within 10 days of the ending of the auction.
Individual NEGATIVE COGGINS TESTS are required for each horse provided by the seller. Any horse sold that will be transported out of state will require a veterinary inspected health certificate as well provided by the seller.
A signed breeders certificate or application for registration must accompany all bred mares and mares with foals at their sides.
The Missouri Horse Auction Sales Inc. and its associates act as agents only on all sales and are not responsible for buyer-seller error or misunderstandings.
Any defects or bad habits MUST be called in horse description or veterinary inspection form. (example: Cryptorchidism, Cribbers, Lameness, Unsoundness, Malocclusions, etc.)
Seller agrees to feed, care, and keep any horse that is sold through Missouri Horse Auction Sales Inc. until buyer arranged transport arrives. Buyers have seven (7) days to pickup/transport horse. After seven (7) days has passed, Seller may charge a reasonable daily board rate set by the seller.
The commission will be ten percent of the selling price. The seller will have the privilege of no sale (Pass Out) of their horse. The Pass Out fee is $100.
A consignment fee of $50 will be deducted from the seller's check to use Missouri Horse Auction Sales Inc online platform. In the case that a horse is a Pass Out, the Consignment fee and pass out fee is due paid directly to Missouri Horse Auction Sales Inc. within 24 hours of the auction closing. This can be paid by debit/credit card (3.5% convenience fee applies) over the phone or by cash being delivered to Missouri Horse Auction Sale Inc. at 951 W. Rosedale Rd, Nixa, MO 65714. If unpaid, the card on your Missouri Horse Auction Sales Inc. account profile will be charged at 48 hours and you are subject to be banned from selling with Missouri Horse Auction Sales Inc. in the future.
All horses listed at the start of the sale must go through the completion of the sale. The only exceptions given will be if the horse dies, becomes unsound or illness occurs. Veterinary statements must be provided in such scenarios.
All horses sold during and after the sale to buyers made by connection of Missouri Horse Auction Sales Inc. platform will be subject to the 10% sales commission.
For it to be expressly understood that in the event that any buyer or seller fails to complete any of the conditions agreed upon when consigning or buying a horse, that they agree to pay all costs of collections, including court cost and a reasonable attorney fee.
